NOTE [This note was first posted at 2:10 PM EST (1910 GMT), Tuesday 31 January 2012, before any returns from the FLORIDA Republican Presidential Primary could have been known]: There has been more than a little "buzz", of late, about the possibility of a protest by losing candidates in this Primary- most notably, the presidential contender who ends up in second place- against the National Convention delegates from FLORIDA being awarded on a 'Winner Take All' basis to the statewide winner of this Primary. It should be fairly noted that any such protest after the voting in a Presidential Primary has already taken place would have to be taken up with the Republican National Committee, the Rules Committee (or equivalent) of the 2012 Republican National Convention and (ultimately, should such a protest even make it that far) a Roll Call vote on the floor of that Republican National Convention itself this coming late summer. Assuming- if only for sake of this note- that such a protest emerges in the first place, it is probably going to very closely resemble what happened 40 years ago re: the *Democratic* National Convention, where Senator/former Vice President Hubert Humphrey protested- and, thereby, attempted to challenge- the rule allowing for all National Convention delegates from California to be awarded to Senator George McGovern [the eventual presidential nominee] as the result of a Winner Take All Presidential Primary in *that* State in 1972. A Federal court challenge ensued- culminating (on the very eve of the Convention) in a case argued before the United States Supreme Court (this being Brown v. O'Brien [409 U.S. 1 (1972)]), in which the Supreme Court decided *not* to decide the issue, leaving the resolution of this dispute to the 1972 Democratic National Convention itself. All in all, any such protest as regards the binding of delegates to the statewide winner of today's FLORIDA Republican Presidential Primary is likely to have more than a few elements similar enough to what happened on the *Democratic* side of things four decades ago now. Thursday 22 September - Saturday 24 September 2011. The Republican Party of Florida will host their "Presidency 5" Debate and Straw Poll at the Orange County Convention Center in Orlando. 24 September 2011 2,657 delegates cast votes in the straw poll.

Friday 27 April - Saturday 28 April 2012: Quarterly Meeting. The At-Large delegates are selected according to the results of the primary. The party is selecting a full delegation of 99 and 96 alternates in compliance with RPOF rules. There are no alternates for RPOF Chairman, RPOF’s National Committeeman, or RPOF National Committeewoman. Notes:
On 19 May 2011, Florida Governor Richard L. "Rick" Scott (Republican) signed HB 1355 which, among other things, creates the Presidential Preference Primary Date Selection Committee. This committee has until 1 October 2011 to set the date of the 2012 Presidential Primary. That date will be no earlier than the 1st Tuesday in January (3 January 2012) and no later than the 1st Tuesday in March (6 March 2012). There are 10 members: The Secretary of State (the non-voting chair), 3 appointed by the Governor (no more than 2 may be from the same political party), 3 appointed by the Speaker of the House of Representatives (no more than 2 may be from the same political party), and 3 appointed by the President of the Senate (no more than 2 may be from the same political party). On 30 September 2011, the Florida Presidential Preference Primary Date Selection Committee voted 7-2 to hold the Florida Presidential Primary on Tuesday 31 January 2012. The date appears to put the Florida Republican delegate selection plan in violation of the Rules of the Republican Party. Rule 15(b)(1) states "No primary, caucus, or convention to elect, select, allocate, or bind delegates to the national convention shall occur prior to the first Tuesday in March in the year in which a national convention is held. Except Iowa, New Hampshire, South Carolina, and Nevada may begin their processes at any time on or after February 1 in the year in which a national convention is held ..." Rule 16(a) indicates that Florida will forfeit 50% of their National Convention delegates. "If any state or state Republican Party violates The Rules of the Republican Party relating to the timing ... the number of delegates to the national convention from that state shall be reduced by fifty percent (50%) ...
